Welcome to Testorithm. These Terms & Conditions ("Terms") govern your use of the Testorithm website, platform, and associated services (collectively, the "Platform") operated by Testorithm Private Limited ("Testorithm", "we", "our", or "us").

1. Acceptance of Terms

By accessing, registering for, or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform.

2. Definitions

  • Platform: The Testorithm website, mobile applications, and software infrastructure.
  • User: Any individual who accesses the Platform.
  • Student: A User registered to take assessments and access diagnostic tools.
  • Parent: A User with read-only access to a linked Student's performance data.
  • Teacher: An independent educator utilizing the Platform to conduct sessions.
  • Services: The educational, diagnostic, and analytical tools provided by Testorithm.

3. Eligibility

You must provide accurate and complete information during registration. Users must be of legal age to form a binding contract, or have explicit parental or guardian consent to use the Platform. You are permitted to hold only one individual account.

4. User Accounts

You are strictly responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized access. Testorithm reserves the right to suspend or terminate accounts that violate these Terms or present a security risk.

5. Description of Services

Testorithm provides an AI-powered educational diagnostic platform featuring:

  • Mock Tests and Practice Questions
  • Diagnostic Reports and Performance Analytics
  • AI Explanations for assessment questions
  • Progress Tracking and Membership Services
  • Facilitation of Teacher Sessions (when available)

6. Acceptable Use & Academic Integrity

You agree to use the Platform responsibly. You strictly must not:

  • Cheat, manipulate, or artificially inflate assessment scores.
  • Share your account credentials with others.
  • Copy, scrape, or distribute assessment questions.
  • Use bots, scripts, or reverse-engineer the platform.
  • Harass, abuse, or use inappropriate language toward other Users or Teachers.
  • Impersonate any person or entity.

7. Assessment Rules

Assessments are designed to simulate real exams. Scores are generated automatically based on your inputs. Test integrity is actively monitored; any suspicious behaviour may invalidate your diagnostic insights. Testorithm is not liable for technical interruptions that may affect your attempt.

8. Behavioural Analytics

Testorithm records behavioural events during assessments—such as time per question, navigation paths, skipped questions, and answer modifications. This data is strictly utilized for generating educational diagnostic insights and improving the Platform.

9. Artificial Intelligence Limitations

Testorithm utilizes Artificial Intelligence (AI) to assist learning. You acknowledge that AI responses are informational only and may occasionally be incorrect or incomplete. AI features are supplementary and should not replace professional educational guidance or verified study materials.

10. Memberships & Payments

Access to premium features requires a paid subscription. Billing is processed securely in advance based on your selected plan. You authorize us to charge your payment method for all applicable fees and taxes. Testorithm reserves the right to suspend access in the event of failed payments.

11. Refund Policy

Given the digital nature of our SaaS product, services are generally non-refundable once accessed. For full details on refund eligibility and cancellation procedures, please refer to our dedicated Refund Policy.

12. Intellectual Property

Testorithm exclusively owns the Platform, including but not limited to the website, apps, questions, graphics, logos, AI prompts, reports, diagnostic algorithms, and source code. Users are granted a limited, non-exclusive, non-transferable license to use the Platform for personal educational purposes.

13. User Content

Users retain ownership of personal content uploaded to the Platform (e.g., reflection notes, profile pictures). However, you grant Testorithm a worldwide, royalty-free license to host, display, and process this content for the purpose of providing the Services.

14. Third-Party Services

The Platform integrates with third-party providers, including Razorpay (payments), cloud hosts, and AI providers. Your interaction with these services is also governed by their respective terms and policies.

15. Availability & Platform Evolution

We do not guarantee uninterrupted access to the Platform. Testorithm may undergo maintenance, and features may be added, modified, or removed as the platform evolves to improve educational outcomes.

16. Beta Features

As we continue to launch and test new functionalities, certain features may be marked as "Beta." These are experimental, subject to change without notice, and may contain bugs. User feedback is strongly encouraged.

17. Teacher Sessions (Future Capabilities)

Where applicable, Teachers operating on the Platform are independent educators, not employees of Testorithm. Testorithm solely facilitates the connection and session infrastructure and does not guarantee specific academic outcomes resulting from these sessions.

18. Prohibited Activities

In addition to the Acceptable Use Policy, you explicitly agree not to:

  • Sell, rent, or commercialize your account.
  • Screen record or distribute premium platform content.
  • Engage in data scraping, automation, or API abuse.
  • Upload copyright-infringing materials, spam, or create fake accounts.

19. Suspension & Termination

Testorithm reserves the absolute right to suspend or terminate your account without prior notice if you engage in fraud, abuse, policy violations, illegal activities, or payment disputes.

20. Disclaimer: No Guarantee of Results

Testorithm is an educational diagnostic tool. We strictly do not guarantee exam success, specific ranks, college admissions, selection, or job placement. Your actual performance entirely depends on your own preparation, dedication, and external factors beyond our control.

21. Limitation of Liability

To the maximum extent permitted by law, Testorithm shall not be liable for any indirect, incidental, or consequential damages arising from lost data, service interruptions, technical failures, incorrect AI responses, or examination outcomes.

22. Indemnification

You agree to indemnify, defend, and hold harmless Testorithm and its affiliates against any legal claims, damages, or expenses arising from your misuse of the Platform, illegal activities, or violation of these Terms.

23. Privacy

Your use of the Platform is also governed by our Privacy Policy, which details how we collect and process your personal and behavioural data.

24. Changes to the Terms

We reserve the right to modify these Terms at any time. Significant changes will be communicated via the Platform. Your continued use of the Platform after such updates constitutes acceptance of the revised Terms.

25. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts located in Dehradun, Uttarakhand.
